ECJ gives guidance on transfrontier wastes
The European Court of Justice has given some important guidance on the meaning of the 1993 EC Regulation concerning the import and export of wastes. Rulings from the European Court are of particular significance in this area because Community Regulations are directly applicable nationally without the need for transposing legislation and the 1994 UK transfrontier shipment regulations deal mainly with procedural issues rather than substantive law.
