ECJ upholds power to charge for participation in planning decisions

An Irish law requiring members of the public to pay a fee before participating in planning decisions has survived a challenge before the European Court of Justice. No such requirement yet exists in British law, but given Treasury policy on cost recovery and the desire to speed up planning decisions, the ECJ decision might provide a temptation too difficult to resist.
