Scottish amendments to PPC regulations

A host of minor amendments to the pollution prevention and control regulations came into force in Scotland on 2 July.1 The Scottish Executive consulted on the amendments earlier this year (ENDS Report 360, p 39 ).

The amendments make minor changes and corrections to the PPC regime which mirror changes already made in England and Wales. These include extending the powers of the Scottish Environment Protection Agency to serve enforcement notices to mobile plant. Another amendment ensures that certain inorganic chemicals activities regulated under IPC remain caught under PPC.

One amendment excludes from regulation plant used for research and development. Another broadens the current exclusion from the regulations for the treatment of "waste soil" using mobile plant to include the recovery or incineration of "contaminated material, substances or products" relating to land or groundwater remediation.
