Pesticide approval and competition

The Court of First Instance of the European Court of Justice has recently stressed that the purpose of the European regime for the approval of constituents in pesticides is to protect human health and the environment. The Court decided that the promotion of competition between producers is not one of its aims. It followed that one company with access to relevant data could effectively use its position to block the approval of an existing ingredient in favour of a new constituent over which it had a patent.
