Contaminated land determinations risk legal challenge

The Environment Department (DEFRA) has issued guidance on the use of soil guideline values (SGVs) amid fears that some contaminated land determinations could face legal challenge.1The problem stems from the conservative way in which SGVs were calculated and the absence of guidance to help local authorities use these values in assessing when intake of the substance in question is "unacceptable".
