European Court rules on recycling and metal processing

The long-running legal dispute between scrap metals business Mayer Parry and the Environmental Agency as to whether the company's operations entitle it to be considered an accredited reprocessor under the packaging waste regime appears to be over following a ruling by the European Court of Justice on the meaning of "recycling". The decision clarifies the relationship of waste definitions in the packaging and waste framework Directives, and is consistent with the ECJ's reluctance on environmental grounds to see recycling operations excluded from waste management controls.
