Legal duties of nuclear operators

In a recent case against the UK Atomic Energy Authority, the Scottish Court of Session has considered the nature of the legal duties on operators of nuclear facilities, and held that it could grant a declaration that UKAEA was in breach of its statutory duties where particles of nuclear material were found on local beaches and property. It declined, however, to order a specific monitoring and clean-up programme as part of the remedy sought.
