EU law defences available in criminal prosecution

The Court of Appeal has reviewed the extent to which a defendant to a criminal charge can challenge the validity of the national legislation at issue as being incompatible with EU law. The Court adopted a generous approach and, while the case was concerned with pesticide control arrangements, the principles have wider applicability to environmental law generally.
