Appeal Court criticises procedures for classifying bird protection areas

The Court of Appeal has held that the Secretary of State was entitled to remove a site originally proposed as a Special Protection Area under the EU birds Directive as no longer justifying special status. But in doing so it strongly criticised the lack of transparency in the current procedures for classification and the Government's failure to update planning guidance on the subject.
