Statutory noise nuisances

Statutory changes can often raise difficult problems concerning the continuing legal effect and validity of what had taken place under previous legislation. In a judgement which will come as some relief to local authorities, the House of Lords has overturned previous decisions of the Divisional Court and essentially preserved the effect of statutory nuisance orders made under legislation which was repealed by the Environmental Protection Act 1990.
