First European Court ruling on environmental assessment

In its first ruling on the 1985 EC Directive on environmental assessment of major projects, the European Court of Justice (ECJ) has held that a German law introduced two years late failed to comply with the Directive with respect to transitional arrangements. The judgement is likely to discourage Member States from making transitional exemptions from EC requirements when they are late in implementing Directives in future.
