Third duty of care case

A Middlesborough metal treatment business has been convicted of two offences under the "duty of care" provisions of the Environmental Protection Act 1990.

The duty of care came into force on 1 April 1992, but only two prosecutions appear to have been taken under it to date. Both were taken by Merseyside Waste Regulation Authority, and involved a restaurateur and a demolition contractor. Fines of £200 and £800 were imposed in these two cases (ENDS Report 212, pp 34-35
