Jail sentences for environmental offences

In November, we reported what was believed to be the first case of an environmental offence to result in a jail sentence (ENDS Report 214, p 42 ). However, Merseyside Waste Disposal Authority has informed us that it secured a custodial sentence in a case in July 1988.

The sentence was imposed by Liverpool Crown Court after George Whitelock was convicted of two charges of fly-tipping waste at sites in Bootle and Liverpool in breach of section 3(1) of the Control of Pollution Act 1974. Judge Morris-Jones said Mr Whitelock had shown a complete disregard for the Act and sentenced him to 28 days in prison for each offence, to be served concurrently.
