Act of God no defence for chemical leak

South West Water has been fined £3,000 after a chemical leak from a water treatment works polluted a river and killed 1,000 fish. An unusual aspect of the case was a defence submission that the leak was caused by a lightning strike - but the outcome suggests that the courts are unlikely to be sympathetic to such pleas when there are known defects in emergency arrangements.
