New waste management offence in force in April

One of the main waste management offences in the Environmental Protection Act 1990 will come into force on 1 April, ahead of the new waste management licensing system to be introduced under the Act. An Order made in December will also provide new powers for waste inspectors from 1 April.1

Most of the provisions of the 1990 Act brought into effect by the Order enable the Secretary of State to exercise his powers to make regulations in areas such as the duty of care, recycling credits and radioactive substances. They also paved the way to the introduction of a new system of hazardous substances consents under the Planning (Hazardous Substances) Act 1990 (ENDS Report 181, pp 28-9).
