Entry into force of EPA provisions on waste, contaminated land

Provisions in the Environmental Protection Act 1990 dealing with the collection and recycling of waste will come into force on 1 April, under a Commencement Order made in mid-February.1 The Order has also paved the way for regulations to establish public registers of potentially contaminated land.

The Order is the eleventh in a series with which the 1990 Act is being brought into force. It contains two implementation dates.

On 14 February, part of section 143 came into force with the effect that the Secretary of State is now free to make regulations prescribing what form the new public registers of potentially contaminated land should take.
