Health authority makes history with first EPA prosecution

North Tyneside Health Authority (NTHA) has become the first party to be prosecuted under Part I of the Environmental Protection Act 1990. It was fined £2,500 in January after operating a clinical waste incinerator without authorisation.

The prosecution was made under the local authority air pollution control system established by the Act. Clinical waste incinerators were among the initial batch of processes to come under this regime last April, and operators had until 30 September to apply for an authorisation.

Last June, North Tyneside Metropolitan Borough Council wrote to the NTHA reminding it to apply for an authorisation for its incinerator at North Tyneside General
