Radioactive waste disposal - consultation requirements

Statutory provisions relating to consultation with local authorities over authorisations for radioactive waste disposal have been misinterpreted by the Environment Secretary, according to the Divisional Court.

Regina v Secretary of State for the Environment ex parte Dudley Metropolitan Borough Council (The Independent Law Reports, 16 June 1989) appears to be the first reported case concerning the interpretation of the Radioactive Substances Act 1960.
