Construction site noise

A local authority is entitled to seek an injunction in dealing with serious levels of noise from construction works, the Court of Appeal has recently held. The decision, the latest in a series of cases concerning the use of residual powers available to local authorities under section 222 of the Local Government Act 1972, is the first of its type dealing with noise pollution, and strengthens significantly the hand of local authorities in enforcing statutory pollution controls
