Waste disposal licences and appeals

The Secretary of State's legal powers in deciding an appeal against the revocation of a waste disposal licence do not permit him to vary the conditions contained in the licence, according to a High Court decision.

R v Secretary of State for the Environment ex parte Wimpey Waste Management Ltd (High Court, 14 April 1987, unreported) is the latest of a series of High Court decisions during the past 12 months concerning waste disposal, but appears to be the first specifically addressed to the provisions under the Control of Pollution Act 1974 concerning appeals.
