Planning controls and waste disposal

The High Court has recently held that a condition in an old planning permission concerning restoration of quarry works can impliedly authorise commercial waste disposal operations.

In R v Surrey County Council and A & J Bull (Southern) Ltd ex parte Monk (J Plan & Env Law, November 1986, 828), the court had to interpret a condition in a planning permission granted in 1952 for what had originally been a small quarry, but one that had grown considerably in scale over the years.
