Wind farm falls foul of nuisance noise claim

Compliance with specific noise provisions in a planning permission does not prevent claims for statutory nuisance, according to a recent ruling

A recent ruling is a salutary reminder for wind farm operators that compliance with specific provisions in a planning permission regarding the noise levels emanating from installed turbines does not prevent that noise, when objectionable to those in nearby domestic properties, from resulting in a claim for statutory nuisance.
