High Court endorses CJEU’s landmark ‘People over Wind’ ruling

A High Court judge has dismissed a developer’s claims that last year’s landmark ‘People over Wind’ European court judgment concerning habitats regulation assessments was ‘wrongly decided’.

Developer Gladman’s legal challenge sought to overturn the secretary of state’s decision to refuse planning permission for a development of 225 homes near Cliffe Woods in Kent.

James Brokenshire, who has returned to the backbenches following Boris Johnson’s cabinet reshuffle, refused Gladman’s appeal in November 2018 after considering the Court of Justice of the European Union (CJEU) decision in People Over Wind and Sweetman v Coillte Teoranta.
