Environmental assessment and the "direct effect" doctrine

The High Court has held that the 1985 EC Directive on environmental assessment is not capable of having direct effect before national courts. Mr Justice Tucker's decision will provide some relief to private developers concerned at the uncertainties of EC law, but appears to be at odds both with previous British case-law and with the European Commission's thinking on the subject.
