Q. What is regulation 38(1)(a)?

A. According to the EA's current offence response options document, the regulator uses regulation 38(1)(a) of the Environmental Permitting Regulations 2016 to take action against offences relating to water discharge activities or groundwater activities. It can also be used to take action against firms and individuals that operate without or other than in accordance with a permit.
