Ruling adds to confusion over planning and pollution controls

The potential overlap between planning law and specialised pollution controls has long been a source of legal difficulty. Current government advice is that planning authorities should assume pollution control regimes will be applied and enforced correctly, and should not try to duplicate controls. But a recent High Court decision appears to create potential confusion about where to draw the line between regimes.
