EU emissions trading: Judge rejects challenge to suspension of free allowances

A judge has rejected a challenge to the UK government’s decision not to support an oil and gas company affected by the suspension of its free emissions allowances for the EU emissions trading system (ETS) in the run-up to Brexit.

Repsol, a company that operates an offshore oil and gas installation called Bleo Holm, did not receive €2m in free ETS allowances for 2018 as a result of a decision to suspend the free allocation of allowances to UK companies made by the European Commission, which feared that the UK’s departure from the EU would lead to a glut of free allowances on the market.
