Undue discrimination in waste disposal arrangements

The Appeal Court has held that tendering arrangements for the disposal of waste made by Avon County Council were invalid on the grounds of undue discrimination. The judgement is likely to cause many authorities to re-examine the terms of existing tender documents, and has highlighted potential contradictions between environmental and other objectives built into the Environmental Protection Act 1990.
