Appeal Court ruling on planning and pollution interface

The High Court's refusal last September to quash a planning permission granted by the Environment Secretary for a clinical waste incinerator near Gateshead (ENDS Report 225, pp 44-45 ) has been upheld by the Appeal Court. The High Court had provided valuable guidance on the relationship between the planning system and integrated pollution control (IPC), and while the Appeal Court has endorsed its approach it has also provided a slightly different gloss on the issues.
