ECJ rules again on legal base of environmental law

The European Court of Justice (ECJ) has rejected a challenge by the European Parliament to the legal basis of the 1993 EC Regulation on waste shipment. The ruling underscores the Court's insistence that the choice of legal base must be determined by objective factors, and tacitly rejects any suggestion that it should be swayed by considerations such as Parliament's desire to have a greater influence over the legislative process.
