House of Lords rules on "buying" planning permissions

The extent to which developers are entitled to offer financial inducements to local planning authorities in order to encourage them to grant planning permissions has for many years been an issue of legal and political controversy. In a recent decision concerning out of town shopping centres, Tesco Stores Ltd v Secretary of State for the Environment and others ((1995) 2 All England Law Reports 577, May 1995), the House of Lords has attempted to clarify the principles involved.
