Insurance and landfill pollution

Third party liability provisions in a landfill company's insurance policy did not cover unexpected accidental pollution damage which arose after the disposal operation had ceased, the Court of Appeal has held. Although the wording in the firm's insurance policy is believed not to be common, the court's restrictive interpretation in Middleton v Wiggins and another (Court of Appeal, Civil Division, 14 June 1995) will cause many in the insurance and waste industries to check the precise terms of their policies.
