Statutory noise nuisance and the burden of proof

Noise remains one of the most widespread causes of environmental concern among members of the public. A recent decision of the Crown Court concerning statutory noise nuisance has confirmed that complaint proceedings by individuals are in the nature of criminal proceedings requiring a high standard of proof, and illustrates the difficulty facing courts in balancing the opinions of lay witnesses against British Standards on noise.
