Environmental assessment rules leave much to Member States

Amendments agreed by Environment Ministers in December to the 1985 EC Directive on environmental assessment have extended the existing lists of projects subject to assessment, as well as introducing new rules for determining when environmental assessments are required and their content. But the extent of the changes which the new Directive will require in UK legislation and practice will depend to a significant degree on how the Government interprets some of its key provisions.
