Environmental challenge to EC funding decision fails standing tests

A recently reported decision of the European Court has confirmed the difficulties facing third parties such as environmental groups which wish to challenge the legality of European Commission decisions. Coupled with a later decision concerning the French nuclear tests in the Pacific (see pp 43-44 ), the ruling confirms that the Court is likely to maintain a restrictive interpretation of EC Treaty rules concerning the status of parties who may appear before it.
