Bjerregaard poised for fresh move on environmental liability

Environment Commissioner Ritt Bjerregaard is expected to make a new bid in November to persuade her fellow Commissioners to agree how the EC should tackle liability for environmental damage. Three options remain on the table, although she is still leaning towards proposing that the EC should accede to the 1993 Lugano Convention on environmental liability. But although superficially more attractive than putting forward the EC's own legislation, such a move's chances of securing a convergence of national liability laws will remain far from clear until the dividing line between the EC's and Member States' legal competence in acceding to the Convention is agreed.
