European Court rules on dangerous substances Directive

The European Court of Justice has held that an EC Directive laying down controls on cadmium discharges to the aquatic environment cannot be relied upon by national courts where a Member State has failed to implement the Directive. Case C-168/95 Luciano Arcaro (ECJ 26 September 1996) was a reference from an Italian court and has wider implications for other environmental Directives.
