Environmental assessment - no direct effect?

The High Court has recently held that reactivated old planning permissions for mineral development are not subject to statutory environmental assessment requirements. The decision has broader implications because the court refused to consider possible application of the 1985 EC Directive on environmental assessment on the grounds that none of its provisions have "direct effect".
