Strict liability for waste disposal offences

The High Court has held that it is not necessary to prove that a defendant knew that licence conditions were being breached in order to secure a conviction for waste disposal offences under Part II of the Environmental Protection Act 1990. The principle is in accordance with case law under previous waste legislation, and although the ruling was not too surprising it will assist the Environment Agency in enforcing waste management controls.
