Damages claim for breach of EC laws struck out

The High Court has struck out a shellfisherman's claim for damages for losses allegedly incurred as a result of the failure of the Government and regulatory bodies to fulfil their obligations under various EC environmental Directives. The lengthy judgment of Mr Justice Carnwath, who is rapidly establishing himself as a leading judge on environmental law, has wider application, and places limits on the possibility of claims for damages in respect of many Community environmental laws.
