Liability in nuisance for waste disposal operations

The High Court has held the operators of a landfill site liable in a nuisance action brought by a neighbouring landowner. The judgment of His Honour Judge Lloyd in Blackburn v ARC Ltd (High Court, Queen's Bench Division, 27 November 1997) contains a valuable exposition of contemporary principles of law, particularly on the continued potential liability in common law nuisance even where a site has received the necessary authorisation, and on the approach to quantification of damages in cases of environmental pollution.
