Agency sore after asbestos waste case thrown out

An Environment Agency prosecution of two brothers allegedly involved in illegal disposal of asbestos waste was thrown out by Leeds Crown Court in September. The brothers had been sentenced in an earlier prosecution for safety and employment offences, and the judge, who had debarred himself from imposing a further sentence for the waste offences, ruled that the Agency's prosecution would be an "abuse of process". The decision raises important questions about prosecutions where two regulatory authorities bring separate charges for offences arising out of a chain of events.
